The following information explains how we collect personal data when you use this website. Personal data refers to any information that can be linked to you personally, such as your name, address, email address, or user behavior. We ask that you read the following information carefully.

The legal provisions governing the protection of your data can be found in the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).

You can contact our Data Protection Officer at datenschutzbeauftragte@fotoraabe.de or at our mailing address with the addition “Data Protection Officer.”

2. Use and Disclosure of Personal Data

Collection of personal data when using the contact form or submitting an inquiry via email

When you use our contact form, we collect and store your name, phone number, and email address, as well as any additional information you voluntarily provide, for the purpose of responding to your inquiry.

If you send us a contact request via email, we collect and store your email address and the data contained in the email.

The legal basis is Article 6(1)(f) of the GDPR, as we have a legitimate interest in responding to your inquiries. The data will be deleted once the purpose of storage no longer applies, i.e., after we have responded to your email or contact form inquiry or once the matter related to the inquiry has been conclusively resolved.

You have the right to withdraw your consent at any time without affecting the lawfulness of the processing carried out on the basis of your consent.

Online Ordering / Reordering

If you wish to order photos, you must provide your personal data in order to conclude the contract; we require this information to process your order. Required information necessary for the execution of the contract is marked separately; additional information is optional. We process the data you provide to fulfill your order. To this end, we may share your payment information with our bank. The legal basis for this is Article 6(1)(b) of the GDPR.

We are required by commercial and tax law to store your address, payment, and order data for a period of ten years. However, after two years, we restrict the processing of your data, meaning it is used solely to comply with legal obligations.

To prevent unauthorized access by third parties to your personal data, particularly financial data, the ordering process is encrypted using SSL technology.

Online applications

If you apply for a job posting with us or enter your application information into the contact form provided for this purpose without applying for a specific position, we will collect your personal data—such as your name, address, and phone number—and store it for the duration of the selection process. Your data will be used exclusively by authorized personnel in the Human Resources department or by management for processing within the scope of the selection process. Your personal data will not be disclosed to third parties.

If a specific position for which you are applying has already been filled, but you are a candidate for future employment or employment at a partner company or subsidiary based on your profile, we will obtain your express consent before further storing or forwarding your application, unless you have already consented to such storage or forwarding in your application.

If you submit a speculative application to us using our general contact email address, the content of your application email may be viewed by personnel not authorized to do so. There is a policy that application documents must be forwarded unopened to the Human Resources department immediately, and the receipt and forwarding emails must be deleted. If you wish to prevent this, please contact us by phone before submitting your unsolicited application so that we can provide you with the contact information of the appropriate contact person.

The legal basis is Art. 6(1)(a) GDPR, as you consent to the processing of your data as described above when you submit your application documents.

The data will be deleted if you withdraw your consent to the use of this data, without affecting the lawfulness of the processing carried out on the basis of your consent, provided that no statutory retention periods apply. In such cases, the data will be blocked instead of deleted. Furthermore, application documents will be deleted three months after the selection process has concluded, unless you have expressly agreed to the retention of your application data for future job openings.

3. Collection of Personal Data When Visiting Our Website

When you visit our website, various server statistics are automatically stored that your browser transmits to our provider’s server. Among other things, the name of the accessed webpage, the file, the date and time of access, the amount of data transferred, a notification of successful access, the browser type and version, the user’s operating system, the referrer URL (the previously visited page), IP address, and the requesting provider.

This data is used for statistical analysis of visits to our website and cannot be traced back to specific individuals by us. The IP address is anonymized. This data is not combined with other data sources.

The legal basis for data collection is Art. 6(1)(f) GDPR. Our legitimate interest in collecting this data is based on the fact that we can use the data to optimize our offering for users, for example by preventing access from malicious sites or optimizing access via certain browsers, and because the IP address log is necessary to deliver the page to the visitor in the first place.

While you generally have the right to object to this data collection, this is effectively not an option in this case, as otherwise the use of the site would be impossible.

The data will be deleted as soon as it is no longer needed for the purposes mentioned above.

Cookies

Our website uses cookies. These are small text files that are stored on your device and save certain settings and data for exchange with our system via your browser. A cookie typically contains the name of the domain from which the cookie data was sent, as well as information about the cookie’s age and an alphanumeric identifier. Cookies enable our systems to recognize the user’s device and make any preset preferences immediately available. As soon as a user accesses our website, a cookie is transmitted to the hard drive of the user’s computer. Cookies help us improve our website and offer you a better, more personalized service. They allow us to recognize your computer when you return to our website, thereby storing information about your preferred activities on the site and tailoring our website to your individual interests. This includes, for example, advertising that matches your personal interests. In addition, cookies allow us to speed up the processing of your requests.

The cookies we use store only the data described above regarding your use of the website. This is not done by linking the data to you personally, but by assigning an identification number to the cookie (“cookie ID”). The cookie ID is not linked to your name, your IP address, or similar data that would allow the cookie to be associated with you.

We work with business partners who help us make our online offerings and website more interesting for you. Therefore, when you visit the website, cookies from these partner companies are also stored on your hard drive. These are cookies that are automatically deleted after a specified period of time. The cookies from our partner companies also collect data solely using a cookie ID, which enables our advertising partners to target you with advertisements that might actually interest you.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest arises from the fact that we use the aforementioned cookies solely to make the website more accessible to you, do not collect any tracking data in the process, and therefore do not infringe upon your personal rights and fundamental freedoms.

If you do not wish to use browser cookies, you can configure your browser to reject the storage of cookies. Please note that in this case, you may only be able to use our website to a limited extent or not at all. If you wish to accept only our own cookies, but not those of our service providers and partners, you can select the “Block third-party cookies” setting in your browser.

4. Data Security

All information you provide to us is stored on servers located within the European Union. In particular, your personal data is transmitted to us in encrypted form. We use the SSL (Secure Socket Layer) encryption system for this purpose.

5. We will not share your personal information

We do not disclose your personal data to third parties unless you have consented to such disclosure or we are authorized or required to do so by law and/or by official or court orders. This may include, in particular, the disclosure of information for the purposes of law enforcement, to prevent danger, or to enforce intellectual property rights.
